What is it?

Passing the Pre-Exam is your ticket to participating in the EQE.

The book
True or False - A Methodology for the Pre-Examination of the EQE is a 149-page A4-size book that provides a straigthforward methodology for the legal questions as well as for the claim-analysis questions of the Pre-Examination of the Euopean Qualifying Examination (EQE).

The main examination consists of four papers encompassing the drafting of a patent application, replying to a communication from an Examining Division, preparing a notice of opposition and answering legal questions and a legal inquiry from a client. In 2012, a Pre-examination (Pre-Exam) was introduced. Candidates desiring to sit the Main Exam must have passed the Pre-examination. The Pre-Exam consists of twenty multiple-choice questions: ten questions on legal aspects and ten on claim analysis.

The preparation for the Pre-Exam starts with understanding the basic concepts of European patent law, including the legal and formal aspects of the patent system as well as the substantive issues such as scope of protection, priority, novelty, inventive step, clarity and allowability of amendments. Ideally in this period of study, a candidate should be supervised by an experienced European patent attorney or attend a course focusing on the preparation for the Pre-Exam.

This book has been kept compact by only referring to the legal texts and other study material, instead of copying these texts into the book.

Structure of the book

The book discusses the main themes of the Pre-Exam papers and describes in detail how the method works and how it is applied. The book further gives guidance with respect to dealing with the specific kinds of questions that are present in the Pre-Exam.

As an Annex, a comprehensive analysis and detailed model solution of the 2019 Pre-Exam paper is included.

The methodology has been successfully applied by many candidates preparing for the Pre-Exam of the EQE.
